COMPETITION
RULES OF THE "APLUG BACK TO SCHOOL" COMPETITION
I. General provisions:

The competition, the rules of which are set out in these Regulations, will be conducted under the name " APLUG BACK TO SCHOOL" (hereinafter referred to as the "Competition").

The Competition is organised by APLUG SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office at ul. Sejmu Wielkiego 25, 95-060 Brzeziny, NIP: 8331404913, KRS: 00008926, hereinafter referred to as the "Organiser".

The competition is financed from the Organizer's own funds. The Organizer is also the sponsor of the prizes.

The competition is conducted in the territory of the Republic of Poland, via the social networking site Instagram, on the Organizer's profile, i.e. https://www.instagram.com/aplug.pl/

The competition is not organized, sponsored or administered by Instagram or Tik Tok.

The competition begins on September 4th and ends on September 29th at 11:59 PM. The competition will be decided by the end of September 30th, 2025.
II. Competition Rules and Prizes:

Any natural person who is a consumer within the meaning of Article 22 (1) of the Civil Code may be a participant in the Competition (hereinafter referred to as the "Participant").

Employees and associates of the Organizer, as well as their closest relatives, are not eligible to participate in the Competition. An "employee" or "associate" is defined as a person employed under any legal title, including an employment relationship or civil law contract. A "close relative" is defined as a spouse, ascendants (parents, grandparents, etc.), descendants (children, grandchildren, etc.), siblings, spouses of siblings, and adopted persons.

The condition for participation in the Competition is to follow the Organizer's profile - @aplug.pl on the Instagram platform and liking the competition post and leaving a comment under it, in which the Contestant provides their shoe size, along with tagging at least three friends. The Contest post must also be shared by the Contestant on Instagram Stories, tagging the Organizer's profile - @aplug.pl. Meeting the above conditions entitles the Contestant to apply for the prize provided by the Organizer for 2nd and 3rd place. The Organizer also provides a prize for 1st place – the conditions for applying for this prize are described below.

Each comment and share of the contest post on Instagram Stories constitutes a separate entry. Each participant can add an unlimited number of comments, which increases their chances of winning the contest.

The rules of the Competition are as follows:
The Competition Organizer will post on the Instagram platform competition post, and the task of the Competition Participant will be to comment on it in the manner indicated in the content of the post, i.e. by providing his/her shoe size and sharing it on Instagram Stories with the Organizer's tag @Aplug.
Sharing the competition post on Instagram Stories together with tagging the Organizer's account, i.e. the Aplug brand, will constitute a new entry (i.e. another one next to posting a comment; sharing the post itself does not constitute an entry) to the Competition, which increases the Participant's chances.
Fulfillment of the above conditions entitles the Participant to compete for the prize provided for 2nd and 3rd place (details regarding the prizes are described below).
Participants wishing to compete for the first-place prize must record a video advertising Aplug. The topic of the video is optional, but the Jury will select one video that, in the Jury's opinion, constitutes the most interesting Aplug advertisement. The Jury will evaluate both creativity and originality, as well as its adherence to the competition theme. The video must be shared on Instagram or TikTok, with the hashtag #SZKOLAPLUG.

The Competition Organizers will appoint a two-person (or more) Committee whose task will be to ensure the proper conduct of the Competition and to select the awarded Competition Participants – places 2 and 3, as well as to select the Competition Participant whose film will be best assessed by the Committee, which is equivalent to obtaining first place in the Competition and the prize assigned to him.

Each comment and share of the contest post constitutes a separate entry. Each participant can add an unlimited number of comments, which increases their chances of winning the contest. However, each participant must tag three other people in each comment; otherwise, only the first comment will be considered.

Contest entries will be reviewed for compliance with the Contest Rules. This means that the Participant (at least on the day of the Contest's announcement) must have a public Instagram account. Otherwise, the Committee will be unable to verify whether the Contestant has met the Contest Rules, which will result in disqualification.

Decisions made by the Competition Committee acting on behalf of the Organizer are final and binding on all Competition Participants.

The prizes in the Competition are:
1st place – Louis Vuitton LV Trainer Sneaker BLUE;
2nd place – Air Jordan 1 Retro Low OG SP Travis Scott Velvet Brown;
3rd place – A Bathing Ape ABC Camo Shark Daypack Green backpack worth approximately PLN 1,200.
The Organizer also indicates that it is unable to provide the value of the prizes, as their final value depends on the size chosen by the Winner.

The winning Participant will receive an additional cash prize equivalent to one-ninth of the prize. Tax on the prize and cash prize, representing 10% of their total value, will be collected and paid by the Organizer in accordance with the Personal Income Tax Act. Therefore, Participants acknowledge that the cash portion of the prize will not be paid to them, as it will be deducted by the Organizer against the personal income tax payable by the winning Participants.

The Organizers declare that the Prize will be awarded under this Competition in accordance with applicable law, particularly tax law. Prizes cannot be exchanged for cash or other benefits. The right to the Prize cannot be transferred to third parties.

The relevant provisions of the Personal Income Tax Act (PIT) shall apply to the Prize in this Competition – in particular Article 30, paragraph 1, point 2 of this Act.

The results of the Competition will be announced on September 30, 2025, by 11:59 PM via the Instagram platform. and via private message addressed to the winning Participant on the Instagram platform (or Tik Tok).

By the deadline of 14 calendar days from the receipt of information about the Prize by the awarded Participant, the awarded Participant, in order to collect the Prize, is obliged to send a message in response to the previously received information about the Prize awarding, containing: name and surname, address of residence and telephone number.

If, within the time limit specified above, the awarded Participant does not send the Organizers a message meeting the conditions specified above, such awarded Participant loses the right to the Prize, which will be awarded to the Participant who, in the opinion of the Competition jury, took the next place in the Competition.

The prize will be sent via courier within a maximum of 21 business days of the announcement of the winning Contest Participants. The prize can also be collected in person at the Organizer's office, which must be agreed upon in advance in response to the Organizer's notification of the win. In such a case, if the winning Participant so desires, the Organizer offers to collaborate on the creation of an approximately 15-second video recording the prize collection, which will be published on the Instagram profiles of both the winning Participant and the Organizer.
III. Responsibility of the Organizers:
1. The Organizer is not responsible for:
a. the inability to issue the Prize for reasons attributable to the awarded Participant;
b. delays or any obstacles in communication with Participants resulting from reasons beyond the control of the Organizers;
c. damages caused by providing false data or other types of irregularities on the part of the Participant;
d. possible technical problems, in particular related to the operation of the website, internet service providers, e-mail and other or force majeure, which may affect the fulfillment of the conditions of participation in the Competition and which the Organizers could not prevent despite exercising due diligence;
e. the correspondence address provided by the winning Participant becomes outdated, and for other data becoming outdated, preventing the delivery of the Prize, of which the winning Participant failed to notify the Organizers, as well as for the inability to collect or failure to collect the Prize, for reasons attributable to the winning Participant. In such a case, the winning Participant loses the right to the Prize, which remains the property of the Organizers.
IV. Personal data:
1. The controller of the personal data of the Competition Participants within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation; hereinafter referred to as GDPR) Journal of Laws of the European Union L. 2016 No. 119.1 of 2016.05.04 is the Competition Organiser:

Personal data will be processed in accordance with the principles set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU.L.2016.No. 119.1 of 2016.05.04). Personal data is provided by Participants voluntarily, but its submission is necessary to participate in the Competition and successfully collect the Prize. The Organizers process the personal data of those Competition Participants who have been awarded.
3. The processing of personal data will include the following scope of data: name, surname, address, telephone number and the following scope of activities: collection, recording, storage, processing and development.
4. The Organizer will process the personal data of the prize winners in order to organize the proper transfer of the prize and for the publication of the prize-winning Participants, if their username on the portal through which they participate in the Competition constitutes personal data within the meaning of the above-mentioned provisions (GDPR).
5. The personal data of winning Participants will be processed for the period necessary to conduct the Competition and process complaints, i.e., no longer than one year from the end of the Competition. The personal data of winning Participants will be processed for the period necessary to properly deliver the prize and as required by personal income tax regulations. The personal data of winning Participants may be shared with entities cooperating with the Organizer for the purpose of conducting the Competition, in particular in connection with the issuance of prizes, such as postal service providers.
6. The legal basis for data processing as a result of registration and participation in the Competition is:
a) the winning Participant's consent to the processing of personal data (Article 6, paragraph 1, letter a of the GDPR),
b) necessity for the purposes resulting from the legitimate interests pursued by the Administrators in the form of identity verification (of the person taking part in the Competition), enabling participation therein, possible publication of information about the awarded Participants, establishing and pursuing legal claims, protecting the interests of the Organizer (Article 6, paragraph 1, letter f of the GDPR),
c) in the case of awarded Participants – tax settlement of the prizes awarded (Article 6, paragraph 1, letter c of the GDPR).
7. Participants' personal data will not be transferred to third countries.
8. The Participant may request access to their data – deletion, rectification, restriction of processing, or transfer – by sending an email to: info@aplug.pl . The Participant has the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office.
9. The Participant is obligated to notify the Organizer of any changes to the Participant's personal data. Failure to notify the Organizer will result in the inability to issue the prize.
V. Complaints:
1. Any complaints regarding the manner of conducting the Competition may be submitted within 7 days from the end of the Competition.
2. Complaints should be made in writing with the note "Complaint - "name of the competition" and sent to the e-mail address info@aplug.pl or to the correspondence address of the Organizer:
3. The complaint should include:
a) name, surname and exact address of the person submitting the complaint, e-mail address and telephone number;
b) a detailed description of the reason for the complaint.
4. Complaints submitted after the deadline or in a form other than that indicated in paragraph 2 and not meeting the requirements specified in paragraph 3 above will not be considered.
5. The Organizer will consider the complaint and notify the complainant of the decision within 10 days of its receipt.
6. The person filing the complaint will be notified of the Organizer's decision by e-mail or registered letter to the address provided in the complaint.
VI. Final provisions:
1. The Competition Rules are available on the Organizer's website <link> and at the Organizer's office.
2. All content contained in advertising and promotional materials relating to this Competition is for informational purposes only.
3. The Organizer reserves the right to change these Regulations and the duration of the Competition without prejudice to the rights acquired by Participants before the date of the change.
4. In matters not regulated by these Regulations, the provisions of the Civil Code shall apply.
