The Aplug.pl online store (hereinafter referred to as the “Store”) operates on the terms and conditions set out in these Terms and Conditions.
The Terms and Conditions define the conditions for concluding and terminating Product Sales Agreements and the complaint procedure, as well as the types and scope of services provided electronically by the Store, the rules for providing these services, and the conditions for concluding and terminating agreements for the provision of electronic services.
The Store is operated by Aplug Spółka z ograniczoną odpowiedzialnością, with its registered office at ul. Sejmu Wielkiego 25, 95-060 Brzeziny, NIP: 8331404913, KRS: 0000892647.
In matters not covered by these Terms and Conditions, the provisions of the Civil Code and other relevant provisions of Polish law shall apply.
§2 Definitions
CONSUMER – a natural person performing a legal transaction with an entrepreneur not directly related to their business or professional activity.
PRODUCT – a movable item available in the Store, which is the subject of the Sales Agreement.
ACCOUNT – a set of resources and settings created for the Customer within the Store.
ORDER FORM – an interactive tool available in the Store, enabling the placement of an order by adding Products to the basket and specifying the terms of the Sales Agreement, including the method of delivery and payment.
§3 Terms and conditions of use of the store
In order to use the Store, you must have an active email address and access to the Internet.
The Customer is obliged to use the Store in a manner consistent with the law, good manners, and the provisions of these Terms and Conditions.
The recommended web browsers to ensure the proper functioning of the Store are: Firefox, Safari, Google Chrome, Opera, with Cookies and Javascript enabled.
§4 Ordering procedure
Orders can be placed in the Store 24 hours a day, all year round.
Due to their specific nature, the products offered by the Store are second-hand – they are obtained by us from private collectors and individuals who have acquired them through official distribution channels of the respective manufacturer, and are then thoroughly verified for authenticity. Due to the fact that the products were previously owned by a third party, they are classified as used and it is reasonable for them to have such characteristics.
To place an order, the Customer should add the selected Product to the Shopping Cart, fill out the Order Form, select the payment and delivery method, and then confirm the order by clicking the “Order” button.
The Store offers various payment methods, including online payment (e.g., Przelewy24), card payment, bank transfer, and cash on delivery.
The condition for placing an Order in the Store by the Customer is to read the Terms and Conditions and accept its provisions when placing the Order.
The Store reserves the right to cancel an order without giving a reason at any time before its finalization. In such a case, the customer will be immediately informed of the cancellation by email to the email address provided.
§5 Conclusion of the sales agreement
The Sales Agreement between the Customer and the Store is concluded upon confirmation by the Store of acceptance of the order for fulfillment.
After placing the order, the Customer receives confirmation of its acceptance at the e-mail address provided.
Each Sales Agreement will be confirmed by a proof of purchase, which will be attached to the order confirmation sent by email.
§6 Delivery
Products are delivered to the home address or to the designated parcel locker, depending on the choice made by the Customer during the ordering process.
The Store makes every effort to ensure that delivery takes place as quickly as possible, in accordance with the information provided for each Product.
The costs and available delivery methods are clearly indicated during the ordering process.
The order processing time is between 2 and 21 business days.
§7 Consumer rights regarding withdrawal from the sale
In accordance with applicable law, a Customer who is a Consumer has the right to withdraw from the Sales Agreement within 14 days of receiving the Product without giving any reason.
To withdraw from the contract, the Consumer should inform the Store of their decision by means of an unequivocal statement (e.g., by email to info@aplug.pl).
In the event of withdrawal from the contract, the Product should be returned to the Store intact, in its original packaging, with all its components.
The cost of returning the product in the event of withdrawal from the contract shall be borne by the Customer.
§8 Complaints and warranty
The Store is liable to the Customer if the sold Product has a physical or legal defect (warranty). The Customer has the right to file a complaint within 2 years from the date of purchase of the Product.
Complaints may be submitted, for example, by sending an email to the Store's address. The Store is obliged to respond to the complaint within 14 days of its receipt.
If the complaint is accepted, the Store will repair the defective Product or replace it with a fully functional one, or refund the Customer the equivalent of the Product price.
§9 Final provisions
Contracts concluded through the Store are concluded in accordance with Polish law.
The Seller reserves the right to amend the Terms and Conditions. Amendments shall enter into force upon their publication on the Store's website.
Any disputes arising from the performance of sales agreements shall first be settled through mediation, and in the event of failure to reach an agreement, by the court having jurisdiction over the Seller's registered office.
These Terms and Conditions shall be effective from the date of their publication on the Store's website and shall replace any previous versions.
